Age Appropriate Design Code transition period starts next month!

The ICO has confirmed that its Age Appropriate Design Code has completed the parliamentary process and was officially issued on 12 August 2020.  The Code will come into force on 2 September 2020 with a 12 month transition period.

The Code itself has been updated to state that "Providers of information society services likely to be accessed by children should bring their processing in line with the standards in this code by 2 September 2021."

From this date, the ICO must take the Code into account when considering whether an online service has complied with its data protection obligations under the GDPR and PECR.  The courts must also take the provision of the code into account, when relevant, from this date.

The Code will come into force in 21 days on 2 September. The code then provides a transition period of 12 months, to give online services time to conform.
